Professors for Peace Statement on Prospect for Constitutional Reforms

No To Con-Ass

We, the undersigned academics and professionals, are expressing our deep concern as regards the process of reviewing and possibly amending our Constitution.

We acknowledge the importance of discussing ways to improve governance in the country, particularly when it comes to a possible shift to a new, federal form of government. Some of us actually support federalism, while others oppose it. We have nevertheless united in this common statement to acknowledge the importance of evidence-based debate and discussion to root out the main benefits and costs of such a reform.

Given the far-reaching implications of this reform, we believe the process must be much more participatory—including not just those who are for this reform, but also those who oppose it. International policy experience and evidence suggests that constitutional reforms are more effective if deliberations are front-loaded at the crafting stage, rather than belatedly appended once these reforms are already ratified.

The present environment is not conducive to reforming the constitution. The most recent nationwide surveys of SWS and Pulse Asia last March 2018 show that only 25% of our citizens sufficiently understand our existing constitution, while only 37% support the shift to federalism. 64% are against charter change. ‘Changing the Constitution’ also ranked last in the ‘most urgent national concerns’ with only 3% of the Filipinos saying that it should be acted upon immediately.

We do not support calls to channel this reform through a Constituent Assembly.

Almost 80% of Congress is comprised of political dynasties, and the empirical evidence suggests that a majority of them may face deep conflict of interest if a new constitution aims for reforms that level the political playing field. The risk of capture by vested interests affecting our present politics is too great.

We do not support calls to postpone or cancel elections in 2019.

Finally, we believe that there are more pressing and immediate policy challenges that our leaders must address. The rising death toll linked to the anti-drugs campaign, which now includes many children and young people. The killings of political leaders and priests also further raise the spectre of injustice. Rising prices of basic commodities, transportation and other needs are also hitting the poor, our workers, and millions of low income households. If these are unresolved, then how can we credibly unite around “rule of law” and “human rights” under an amended constitution?

A constitution is supposed to bind our nation in common values and a shared vision. It is the very glue that should unite us all in common purpose. If we are to amend the constitution, we must invest not just in the outcome, but in the very process.

This is a broad discussion that must bring together our citizens from all walks of life, professions and political leanings. It is a national discourse that must allay fears, clarify concerns and bring us all towards common ground.

Pahayag Ukol Sa Balakin na Pagreporma ng Saligang Batas

Kaming mga akademiko at propesyunal na lumalagda rito ay nagpapahayag ng marubdob na pag-aalala at taimtim na pagmamalasakit patungkol sa proseso ng muling pagsusuri at ng maaaring pagsususog ng ating Saligang Batas.

Kinikilala namin ang halaga ng pagtalakay sa mga paraan ng pagpapaunlad ng pamamahala sa bansa. Lalong mahalaga, kapag patungkol ito sa posibilidad ng pagpapalit ng uri ng pamahalaan tungo sa federalismo. Ilan sa amin ay nagtataguyod sa repormang ito; may ilan din na sumasalungat. Gayunman, nagbubuklod kami sa aming pahayag na kilalanin ang halaga ng talakayan at palitan ng kuro-kuro batay sa mga patunay at katibayan upang matunton at matukoy ang mga mapakikinabangang benepisyo at magugugol na gastos ng gayong reporma.

Dala ng malawakan at malalimang bisa at implikasyon ng repormang ito, naninindigan kami na ang proseso ay marapat na magkaroon ng higit na pakikisangkot at pakikibahagi—hindi lamang ng mga sang-ayon sa reporma, kundi maging ng mga salungat dito. Pinagtitibay at pinatutunayan ng karanasan mula sa pagbubuo ng mga International Policy o Pandaigdigang Patakaran na ang mga repormang pansaligangbatas ay higit na mabisa kung mauuna ang mataman at masusing pag-aaral at paglilimi sa panimulang yugto ng pagbubuo nito, kaysa kung maganap sa huli ang mga pagdaragdag at pagsususog matapos mapagtibay ang mga repormang ito sa saligang-batas.

Ang kasalukuyang kalagayan ng bansa ay hindi nababagay o naaangkop sa pagrereporma ng saligang batas. Inilalahad ng pinakahuling malawakang sarbey na ginawa sa buong bansa ng SWS at Pulse Asia noong Marso 2018 na 25% lamang ng mga mamamayan ang may sapat na pag-unawa sa kasalukuyang saligang batas, habang 37% lamang ang sumusuporta sa pagpapalit tungo sa federalismo. 64% ang salungat sa pagbabago ng saligang batas. Nasa pinakahuling hanay ng “most urgent national concerns” (o “pinakanangungunang pambansang alalahanin/usapin”) ang “Changing the Constitution” (o ang “Pagbabago ng Saligang Batas”), na may 3% lamang ng mga Pilipino na nagsasabing dapat itong isagawa sa lalong madaling panahon.

Hindi namin itinataguyod na isagawa at isakatuparan ang repormang ito sa pamamagitan ng Constituent Assembly.

Halos 80% ng Kongreso ay kasalukuyang binubuo ng mga political dynasty. Iminumungkahi ng mga patunay at ebidensya na ang nakararami sa kanila ay maaaring maharap sa matinding salungatan ng interes o conflict of interest kung nilalayon ng bagong saligang batas ang pagkakapantay-pantay ng oportunidad sa politikal na larangan. Sa kasalukuyang takbo ng politika sa bansa, labis na malaki at nakaliligalig ang panganib na pangibabawin ang mga pansariling interes sa usaping ito.

Hindi namin itinataguyod ang pagbibinbin o pagkakansela ng halalan sa 2019.

Panghuli, naninindigan kami na marami pang hamon sa mga umiiral na polisiya ang nangangailangan ng agarang pansin at tugon mula sa ating mga pinuno. Isang halimbawa ang dumaraming bilang ng mga pinapatay kaugnay ng kampanya laban sa droga, na kinabibilangan ng maraming paslit at kabataan. Ang pagpatay sa mga politiko at mga pari ay nagpapabigat sa lambong ng kawalan ng katarungan. Ang tumataas na presyo ng mga pangunahing bilihin o basic commodities, ng pasahe at transportasyon, at ng iba pang pangangailangan ay nagpapalugmok sa mahihirap, sa mga manggagawa, at sa milyong pamilya at tahanang may mababang kita. Kung hindi matutugunan ang mga ito, paano pa mapagkakatiwalaan na makakamit ang pagkakaisang umiinog sa “alituntunin ng batas” at sa “karapatang pantao” sa ilalim ng bagong saligang batas?

Ang saligang batas ay tagapagbuklod ng ating sambayanan na may tunguhin at mga pagpapahalagang pinagsasaluhan ng lahat. Ito ang tunay na tagapagbigkis nating lahat tungo sa iisang layunin. Kung irereporma at sususugan natin ang saligang batas, marapat na magtuon tayo ng pansin at halaga hindi lamang sa resultang kalalabasan nito, kundi sa mismong prosesong magtatatag ng ubod at loob nito.

Nahaharap tayo sa malawakang talakayan na kailangang kasangkutan ng mga mamamayan mula sa sari-saring karanasan at antas ng lipunan, hanapbuhay at propesyon, at paninidigang politikal. Isa itong pambansang diskurso at palitan ng kuro-kuro na marapat na magpahupa ng pangamba, magdulot ng kaliwanagan sa mga saloobin, at maghatid sa ating lahat ng mapagsasaluhang pag-unawa.

Ang mga pananaw at opinyon ng mga nakalagda ay hindi kumakatawan sa paninidigan ng mga institusyon at organisasyong kinabibilingan nila. Lahat ay pumirma ayon sa kanilang indibdwal na kakayahan bilang mamamayang sangkot sa edukasyon, pananaliksik, at larangang pampolisiya.
