CODE-NGO Statement on the Anti-Terrorism Bill of 2020

We, the Caucus of Development NGO Networks (CODE-NGO), strongly oppose the Anti-Terrorism Bill. This unconstitutional measure not only infringes on the Filipino’s rights enshrined in the basic law of the land but also endangers Philippine democracy at large.

The Anti-Terrorism Bill is a regression from the democracy that the Filipinos have already won after the ouster of the dictator more than 30 years ago. Among its repressive provisions are as follows: (1) the inclusion of a broadly-defined new crime called “inciting to commit terrorism”; (2) the creation of an Anti-Terrorism Council that will have the authority to mark “terrorists”, and freeze their assets without going through a judicial process; (3) the expansion of surveillance of a suspect’s personal communications; and (4) the authorization of government forces to detain suspects without warrant of arrest. Under these provisions, even a legitimate dissent or complaint against government actions may be seen as an act of terror.

CODE-NGO and our members have stood for democracy since its founding in 1991. Our Covenant for Philippine Development and Code of Conduct highlights the safeguarding of fundamental freedoms and rights as part of the goals for Philippine development. The spirit of the Anti-Terror Bill clearly goes against our principles.

Congress was so callous to railroad the passage of this bill instead of prioritizing measures to address the grave economic, social, and health impacts of the COVID-19 pandemic. Instead of building public confidence by communicating a comprehensive plan to address the pandemic, the Duterte administration certified as urgent the enacting of the Anti-Terror Bill at a time when many Filipinos live in fear – fear of an uncertain future because of loss of jobs and livelihoods, fear for their lives because the virus continues to spread and positive cases continue to rise, fear for their safety because authorities might arrest them for violating quarantine protocols.

We need concrete actions and assurances from government that will foster the “bayanihan” spirit, a greater sense of solidarity during this crisis, not a bill that endangers human rights and civil liberties. We need government’s commitment in helping communities bounce back from this crisis, not a bill that suppresses free speech. We need civic spaces where we can find hope and build a community that helps one another, not a bill that institutionalizes abuse of power.

We want leaders to uphold democratic principles and not resort to draconian policies that will violate the very core of the Filipino values of respect and dignity.
